Este estudio analiza el artículo 146 del Código Orgánico Integral Penal (COIP) de Ecuador, esta trata sobre el homicidio culposo por práctica profesional equivocada. La mala praxis médica es un problema grave en el sistema de salud de Ecuador, y la interpretación inadecuada de este artículo ha generado confusión en los procesos legales relacionados. El objeto de la investigación es analizar la normativa del artículo 146 del COIP y las lagunas de interpretación jurídica para determinar la culpabilidad o inocencia de (...) los profesionales de la salud. Para ello, se emplearán métodos comparativos e históricos, que incluyen revisión bibliográfica, análisis de contenido del artículo 146. Los resultados esperados son demostrar las dudas razonables en la prueba del delito de mala praxis, resaltar la importancia de la bioética en los procedimientos legales. Este estudio busca contribuir a una mejor comprensión del marco legal y brindar ideas para la resolución de casos de mala praxis y homicidio culposo en Ecuador. (shrink)

This article gives a conceptual review of the e-value, ev(H|X) – the epistemic value of hypothesis H given observations X. This statistical significance measure was developed in order to allow logically coherent and consistent tests of hypotheses, including sharp or precise hypotheses, via the Full Bayesian Significance Test (FBST). Arguments of analysis allow a full characterization of this statistical test by its logical or compositional properties, showing a mutual complementarity between results of mathematical statistics and the logical desiderata lying at (...) the foundations of this theory. In this article, I explore the ethical dimensions of same-sex reproduction achieved through epigenome editing—an innovative and transformative technique. For the first time, I analyse the potential normativity of this disruptive approach for reproductive purposes, focusing on its implications for lesbian couples seeking genetically related offspring. Epigenome editing offers a compelling solution to the complex ethical challenges posed by traditional gene editing, as it sidesteps genome modifications and potential long-term genetic consequences. The focus of this article is to systematically analyse (...) the bioethical issues related to the use of epigenome editing for same-sex reproduction. I critically assess the ethical acceptability of epigenome editing with reproductive purposes from multiple angles, considering harm perspectives, the comparison of ethical issues related to gene and epigenome editing, and feminist theories. This analysis reveals that epigenome editing emerges as an ethically acceptable means for lesbian couples to have genetically related children. Moreover, the experiments of a reproductive use of epigenome editing discussed in this article transcend bioethics, shedding light on the broader societal implications of same-sex reproduction. It challenges established notions of biological reproduction and prompts a reevaluation of how we define the human embryo, while poses some issues in the context of gender self-identification and family structures. In a world that increasingly values inclusivity and diversity, this article aims to reveal a progressive pathway for reproductive medicine and bioethics, as well as underscores the need for further philosophical research in this emerging and fertile domain. Aesthetics is thought of as not only a theory of art or beauty, but also includes sensibility, experience, judgment, and relationships. This paper is a study of Bernard Stiegler’s notion of Aesthetic War (stasis) and symbolic misery. Symbolic violence is ensued through a loss of individuation and participation in the creation of symbols. As a struggle between market values against spirit values human life and consciousness within neoliberal hyperindustrial society has become calculable, which prevents people from creating affective and meaningful (...) attachments to symbols in relation to our retentional apparatuses, technology and memory. Such tension can be thought of as a dissonance between overlapping domains of social life, private and public. New Media is a reflection of aesthetic dissonance, an experience such as being bored and entertained at the same time, between antagonistic experiences, values, and behavior. Moreover, new media is at once a medium of customizing aesthetic experience individually as well as the threat and practice of prioritizing calculability and modeling of consumer behavior in favor of capitalistic effectiveness, which results in the simultaneous categorization of an individual as a data point, putting those who do not fit an algorithm’s premises at a disadvantage. Starting from the four principles of Pólya's problem-solving method, by analogy, in this paper we propose a new method of philosophical counseling. Thus, the objectives of this study are as follows: the review of several methods of philosophical counseling; justifying the need for a new method, which we called the IPAA method; developing the four principles – the principle of identification (I), the principle of planification (P), the principle of application (A) and the principle of assumption (A). In order to (...) achieve these, we took into account the fact that the nature of the philosophical problems faced by the clients of the philosophical counselors, whether they are existential, moral or metaphysical, can be solved on their own. Therefore, we argued that if in the first instance, clients really need the input of the philosophical counselors, as long as the latter uses the IPAA method – a problem-solving method – they can offer clients the opportunity to self-counsel. The novelty of the IPAA method consists in the fact that it offers the client, assisted and guided at the beginning by the counselor, the possibility to carry out the act of counseling outside the office, being empowered to apply the four methodical principles mentioned above. The present study is relevant in that the new IPAA method, a method focused on solving everyday problems, is a useful method for both philosophical counselors, as its application in the office helps them to train the clients in researching, understanding and assuming their own lives, as well as for the clients, because if they are assisted in the first instance by the counselor's expertise, they can independently clarify and solve their daily difficulties. El propósito principal de este artículo es ofrecer una primera respuesta a dicha pregunta con base en una revisión preliminar de periódicos y revistas que permiten considerar el problema planteado desde una perspectiva más amplia.En breve, el argumento central que se va a desarrollar es que la construcción de esa autoría pasó por tres etapas: en la primera, durante las décadas de 1840 (...) y 1850, tal proceso se basó en la redacción de anuncios comerciales; en la segunda, centrada en los decenios de 1860 y 1870, predominaron los discursos de alumnas y maestras relacionados con actividades de enseñanza; y en la tercera, ubicada a partir de 1885, se dieron dos tendencias paralelas. Por un lado, algunas docentes comenzaron a dar a conocer sus producciones literarias; y por el otro, el Estado, en vísperas de la reforma educativa de 1886, implementó una política para que las educadoras oraran informes de sus actividades escolares y los enviaran a una revista especializada para ser publicados. The Humean conception of the self consists in the belief-desire model of motivation and the utility-maximizing model of rationality. This conception has dominated Western thought in philosophy and the social sciences ever since Hobbes’ initial formulation in Leviathan and Hume’s elaboration in the Treatise of Human Nature. Bentham, Freud, Ramsey, Skinner, Allais, von Neumann and Morgenstern and others have added further refinements that have brought it to a high degree of formal sophistication. Late twentieth century moral philosophers such as Rawls, (...) Brandt, Frankfurt, Nagel and Williams have taken it for granted, and have made use of it to supply metaethical foundations for a wide variety of normative moral theories. But the Humean conception of the self also leads to seemingly insoluble problems about moral motivation, rational final ends, and moral justification. Can it be made to work? (shrink)

Although climate change has become the dominant concern of the twenty-first century, global powers refuse to implement the changes necessary to reverse these trends. Instead, they have neoliberalized nature and climate change politics and discourse, and there are indications of a more virulent strain of capital accumulation on the horizon. Adrian Parr calls attention to the problematic socioeconomic conditions of neoliberal capitalism underpinning the world's environmental challenges, and she argues that, until we grasp the implications of neoliberalism's interference in climate (...) change talks and policy, humanity is on track to an irreversible crisis. Parr not only exposes the global failure to produce equitable political options for environmental regulation, but she also breaks down the dominant political paradigms hindering the discovery of viable alternatives. She highlights the neoliberalization of nature in the development of green technologies, land use, dietary habits, reproductive practices, consumption patterns, design strategies, and media. She dismisses the notion that the free market can solve debilitating environmental degradation and climate change as nothing more than a political ghost emptied of its collective aspirations. Decrying what she perceives as a failure of the human imagination and an impoverishment of political institutions, Parr ruminates on the nature of change and existence in the absence of a future. The sustainability movement, she contends, must engage more aggressively with the logic and cultural manifestations of consumer economics to take hold of a more transformative politics. If the economically powerful continue to monopolize the meaning of environmental change, she warns, new and more promising collective solutions will fail to take root. (shrink)

John Scottus Eriugena (d. ca. 877) is regarded as the most important philosopher and theologian in the Latin West from the death of Boethius until the thirteenth century. Este artículo recoge de forma resumida, a lo largo de sus páginas, los aspectos más destacables de dicha Tesis Doctoral. Se subraya el aspecto de la educación como elemento fundamental en el pensamiento del filósofo inglés John Stuart Mill, en el sentido (...) de mostrar la educación como aquello que permite sacar al exterior las capacidades, talentos, destrezas que la persona posee. Al mismo tiempo es la educación, en el marco de la cultura, la que afina y refina a la persona, ayudándola a construirse como una persona que se incorpore a la ciudadanía con derechos y deberes y que ejerza esa ciudadanía responsablemente en aras del bien común. La educación hace al ser humano más libre, y la libertad es la esencia de la persona en el pensamiento de Stuart Mill. (shrink)

Andre Gorz is one of the most important contemporary socialist thinkers, acquiring the reputation of an iconoclastic theorist who poses radical questions about the future of the Left. This full length assessment of his work is the first to critically evaluate all of his writings from the 1950s to the '90s. Highlighting the eclectic nature of Gorz's intellectual heritage beginning with his existentialist-Marxist roots in post-war France, Adrian Little creates a unique perspective, arguing that Gorz is primarily a theorist of (...) individual freedom and autonomy. In this context he can be regarded not only as a post-Marxist thinker but as a unique purveyor of individualistic socialism. El presente capítulo presenta un análisis teórico del tipo de amor que involucra la sexualidad, las altas expectativas que genera y la incertidumbre de que se cumplan. Para esclarecer el estudio se distingue entre sexualidad, impulso amoroso (“eros”) y amor propiamente dicho (“ágape”) y se echa mano de conceptos tomados de la filosofía personalista incluidos los de naturaleza, persona, racionalidad, relación y los varios tipos de amor. Clearing algorithms are at the core of modern payment systems, facilitating the settling of multilateral credit messages with (near) minimum transfers of currency. Traditional clearing procedures use batch processing based on MILP - mixed-integer linear programming algorithms. The MILP approach demands intensive computational resources; moreover, it is also vulnerable to operational risks generated by possible defaults during the inter-batch period. This paper presents TORC3 - the Token-Ring Clearing Algorithm for Currency Circulation. In contrast to the MILP approach, TORC3 is a (...) real time heuristic procedure, demanding modest computational resources, and able to completely shield the clearing operation against the participating agents’ risk of default. We present a module based criterion, i.e. a sufficient condition based on the absolute value of the matrix coefficients, for the convergence of Gauss–Seidel method (GSM) for a square system of linear algebraic equations, the Generalized Line Criterion (GLC). We prove GLC to be the “most general” module based criterion and derive, as GLC corollaries, some previously know and also some new criteria for GSM convergence. Although far more general than the previously known results, the proof of GLC is simpler. (...) In this paper I argue that, by combining eliminativist and fictionalist approaches toward the sub-personal representational posits of predictive processing, we arrive at an empirically robust and yet metaphysically innocuous cognitive scientific framework. I begin the paper by providing a non-representational account of the five key posits of predictive processing. Then, I motivate a fictionalist approach toward the remaining indispensable representational posits of predictive processing, and explain how representation can play an epistemologically indispensable role within predictive processing explanations without thereby (...) requiring that representation metaphysically exists. Finally, I outline four consequences of accepting this approach and explain why they are beneficial: we arrive at a victory for metaphysical eliminativism in the ‘representation wars’; my account fits with extant empirical practice; my account provides guidance for future research; and, my account provides the beginnings of a response to Mark Sprevak’s IBE problem for fictionalist approaches toward sub-personal representation.
